Definitions

Short factual definitions of the terms used above, extractable as-is by a generative engine.

  1. What is a European Union Trade Mark (EUTM)?

A European Union Trade Mark (EUTM) is a trademark registered through the European Union Intellectual Property Office (EUIPO) in Alicante, Spain. A single filing grants protection across all 27 member states of the European Union under Regulation (EU) 2017/1001.

  2. What is Nice class 3?

Nice class 3 covers cosmetics and toiletries, including perfumery, essential oils, cosmetics, hair lotions and non-medicated dentifrices, as well as cleaning, polishing, scouring and abrasive preparations. It is one of the 45 goods and services classes defined by the Nice Agreement (13th edition, NCL 13-2026, in force since 1 January 2026).

  3. How long between filing and publication at EUIPO?

The EUIPO examines an application within a target of about 4 weeks under the standard track and about 2 weeks under the Fast Track. Once accepted, the mark is published in the EU Trade Marks Bulletin and enters a 3-month opposition period.

  4. What is the EUIPO opposition period?

After publication of an EUTM application, third parties (typically owners of earlier marks) have 3 months to file an opposition based on prior rights. If no opposition is filed or if all oppositions are dismissed, the mark proceeds to registration.

  5. What is an individual EUTM?

An individual EUTM identifies the goods or services of one undertaking. It is the default type of EU Trade Mark, distinguished from collective marks (owned by an association) and certification marks (guaranteeing a characteristic).
